The second night rule usually applies, but not always.
The trouble is, you never know when that "lighting strike" show is going to happen- St. Louis '08 (which was a "night 1", with Kansas City being night 2) being a perfect example. And, while I know they film every show, I doubt they're all filmed with the quality needed for a possible release, as that would be cost prohibitive. I've heard reports of extra equipment being used at several of the European shows so far, so maybe they're going to film a number of them and decide which one to release later. Although, a number of shows were reported to be professionally filmed during the BITUSA tour, and so far nothing has been released other than a few clips.
I agree in that I don't think another festival show would be ideal, and in keeping with Landau's assertion that they want to do "something different" with each release, you could argue they did that already with the Hyde Park DVD. I've got it- perhaps a show filmed in an iconic baseball park that happens to NOT be located in the Northeasten U.S? He's doing two nights...
